HIPLOGIC PRIVACY POLICY

Welcome to the HipLogic, Inc. ("HipLogic") site and online service (the "Service"). HipLogic values the privacy of its users, and this Privacy Notice is intended to provide you with information with respect to our information handling practices. It describes what information we gather from you, how we use that information, in what instances we may disclose it to third parties, and what we do to protect it. By using the HipLogic Service, you expressly consent to the information handling practices described in this Privacy Notice.

Any information about you that HipLogic collects, uses, or discloses in connection with the SnappLife Service ("SnappLife Service") is done for and on behalf of The Carphone Warehouse Group plc ("Carphone"), and, as such, Carphone owns and will have access to any such information collected by or provided to HipLogic in connection with such SnappLife Service.

The Service is not intended for persons under the age of 13, and we will not knowingly collect information from such persons. If we learn that a child under 13 has submitted personal information to us, we will attempt to delete the information as soon as possible.

WHAT INFORMATION HIPLOGIC COLLECTS

When you use the Service, we need to collect certain personal information from you in order to fulfill your orders and provide the Service and related products to you. What we need varies depending on the how you use the Service and the products that you order. Much of this information will be maintained by HipLogic as part of a permanent customer record of your dealings with HipLogic.

When you email us (for technical support or otherwise), we may ask for certain information to be able to check this record and answer your questions quickly and accurately. When you contact us, in any way, we may make a note of this contact if it is relevant to your permanent record. This allows us to provide a higher level of ongoing customer service.

We will keep your personal information given to us by you or others during your relationship with us.

The personal information HipLogic may collect includes without limitation:

  • details you give us on application forms or via e-mail or otherwise,
  • details you give us so that we can provide you with the Service
  • details about your use of the Service, and
  • details we receive from credit reference and fraud detection agencies.

HOW HIPLOGIC USES YOUR PERSONAL INFORMATION

You agree that we may use and update your personal information:

  • to process any orders you make and provide you with the Service;
  • to provide you with related services;
  • to prevent and detect fraud;
  • to update our records about you;
  • to report and prevent illegal activities;
  • to check your identity; and
  • for payment processing including credit checks and collection.

WHEN HIPLOGIC MAY DISCLOSE YOUR PERSONAL INFORMATION

The personal information we hold about you is confidential. We will only disclose it outside HipLogic and Carphone when:

  • you give us your consent,
  • it is needed by certain reputable third parties involved in providing Services for you,
  • in order to obtain professional advice,
  • we or others need to investigate or prevent crime (e.g., to fraud prevention agencies),
  • the law permits or requires it, or any regulatory or governmental body requests or requires it, even without your consent,
  • there is a duty to the public to reveal the information, and/or
  • in connection with the sale or transfer of all or substantially all of the related business of HipLogic to a third party that assumes the obligations of HipLogic under this Privacy Notice.

HipLogic is a U.S. based company. We are likely to administer your account and provide the Service from centers in countries outside Europe that do not always have the same standard of data protection laws as the UK. However, we will have a contract in place to ensure that your information is adequately protected, and we will remain bound by our obligations under the UK's Data Protection Act even when your personal information is processed outside Europe.

PROTECTING YOUR PRIVACY

To the extent that sensitive personal information is processed about you, we will employ reasonable security measures given the nature of that data. However, you recognize that your use of the Service is entirely at your own risk and that despite our efforts, you personal information may be accessed or taken by third parties outside of our control. We have tried to create a secure and reliable Service for our users. However, we have no responsibility or liability for the security of personal information transmitted via the Internet.

THIRD PARTIES LINKS AND WEBSITES

Our website may provide links and/or banner advertisements to third party sites (e.g., for payment processing via PayPal). Please note that we are not responsible for, and have no control over, information that is submitted to or collected by these third parties, and when you disclose any information to them, you are subject to their privacy policies and other terms and conditions. Since we do not control those websites, you are responsible for reviewing and abiding by the privacy policies and other terms and conditions of these third party sites.

ACCURATE INFORMATION

It is important that you give us accurate information. If you give us false or inaccurate data and we suspect fraud we will record this at the fraud prevention agencies.

You are responsible for informing us that your personal details have changed: for example, a change of address or to your title. You confirm that you will inform us of any change to your personal information as soon as is reasonably practicable in order that we may update our records. Please note that notification of any change to your personal information must be in writing (to the address below), and should include your account and/or telephone numbers with us.

PROHIBITED ACTIVITIES

You agree not use the Service for any illegal purpose, or for accessing, receiving or transmitting any material deemed illegal, indecent, offensive or otherwise unacceptable under UK law. You agree not use any false identity in email or other network communications.

You agree not to use the Service or any part thereof for fraudulent activities, or to breach another organization's security (cross-network hacking). This is an illegal act and prosecution under criminal law may result.

CHANGES TO PRIVACY POLICY

Please note that this Privacy Notice will be reviewed, and may change, from time to time. When we make a material change to this Privacy Notice, we will post a notice on our website along with the updated Privacy Notice.
